Union Pacific Railroad and Norfolk Southern Railway on Jan. 2 responded to comments from competing Class Is and a shipper group about the completeness of the UP-NS merger application filed last month with the Surface Transportation Board.
BNSF Railway, Canadian Pacific Kansas City, CN and CSX on Dec. 29 each told the Surface Transportation Board that the merger application is incomplete and therefore should be rejected. In separate comments, the four rival Class Is said the merger application failed to include sufficient data and information that the STB requires and, as a result, the board should not accept the application.
After UP and NS filed their application on Dec. 19, 2025, the STB called for public input on whether the application as filed is complete. In their response to the comments, UP and NS rejected their competitors' claims.
UP and NS also stated that claims made by National Grain and Feed Association (NGFA) addressed the merits of the merger — not whether the application itself was complete.
