The California Public Utilities Commission (CPUC) has adopted a “first-of-its-kind” regulation that bans transit-rail system operators from using personal electronic devices, such as cell phones, commission officials said in a prepared statement.

CPUC issued the ban in response to the September 2008 collision between Metrolink and Union Pacific Railroad trains in Chatsworth, Calif., that caused 25 fatalities and injuries to more than 100 passengers. Investigators concluded the accident occurred after the Metrolink train engineer failed to stop for a red light because he was distracted by text message exchanges on his personal cell phone.

The new regulations require all personal electronic devices to be turned off and stowed away. The ban pertains to anyone operating an on-track vehicle; anyone dispatching, flagging or otherwise controlling the movement of any on-track vehicle; and anyone performing a task in the zone where they could be struck by any on-track vehicle, commission officials said. Violators will face disciplinary action, including dismissal.

“The CPUC is sending a clear message today to operators tempted by the attraction of cell phone use: It’s not worth it. You will be held accountable,” said Commissioner Mike Florio.
