Court finds Canadian Pacific in contempt in train-crew work hours case

A court in Canada this week found Canadian Pacific (now Canadian Pacific Kansas City) in contempt for not following federal regulation governing the hours that train crews work.

Judge Ann Marie McDonald found that CP failed to limit the number of hours that train crew members can work in 22 out of 38 incidents that occurred in 2018 and 2019. As a result, the Class I violated a court order to abide by a collective bargaining agreement with Teamsters Canada Rail Conference (TCRC) and Transport Canada regulations.

TCRC is the union that represents the train crew workers and filed the contempt motion with the court. Penalties will be determined in a separate hearing. McDonald’s ruling can be read here.

"Canadian Pacific recklessly puts lives on the line in forcing so many train crews to work longer than allowed," said Teamsters Canada National President Francois Laporte in a blog.

CPKC is disappointed by the judge’s ruling, Corporate Communications Director Doniele Carlson said in an email.

"We respectfully disagree with the court’s decision and will be filing an appeal," she said.
