STB proposes new rules for investigations

The U.S. Surface Transportation Board (STB) announced yesterday that it issued a "notice of proposed rulemaking" (NPR) to establish procedures for board-initiated investigations under the STB Reauthorization Act of 2015.

The reauthorization act gave the board authority to initiate investigations only if the issues to be investigated are of national or regional significance, according to an STB press release.

As part of the NPR, the board is inviting public comment on its proposal. The board is proposing a three-stage process: preliminary fact-finding, board-initiated investigation and formal board proceeding.
