The Surface Transportation Board yesterday determined which baseline traffic density data will be used as it conducts the environmental analysis as part of its consideration of the merger application filed by Canadian Pacific and Kansas City Southern.
On March 16, the STB suspended the procedural schedule in its review of the application; directed CP and KCS to address an apparent inconsistency; and indicated which of the two baseline data sets submitted should be used in analyzing the environmental and transportation impacts of the transaction.
Yesterday's decision defines the data to be used and directs applicants to resubmit data and all work papers associated with their operating plan by May 27. Once the board receives that information, amended comments and responsive applications will be due no later than 20 days after the applicants' submission, STB officials said in a press release.
After amended comments and responsive applications are filed, the board will resume an amended procedural schedule in considering the merger application.
