STB clarifies decision in Sanimax v. UP

The Surface Transportation Board (STB) last week clarified a previous decision in the Sanimax USA LLC common carrier obligation and unreasonable practices complaint against Union Pacific Railroad.

The STB partially granted UP’s petition for clarification and found that, pursuant to the partial revocation of the commodity exemptions granted previously, the board will consider granting relief only from Nov. 2, 2021 — the date the partial revocation took effect — forward.

On Nov. 2, 2021, the board denied a motion filed by UP to dismiss Sanimax’s complaint, granted Sanimax’s request for partial revocation of the commodity exemptions at issue, and set a procedural schedule to govern the complaint proceeding.

On Nov. 23, 2021, UP filed a petition for clarification or, in the alternative, reconsideration of the Nov. 2 decision.
