The Surface Transportation Board's (STB) Office of Environmental Analysis (OEA) late last week issued the final scope of study for the environmental impact statement the office is preparing for the merger application of Canadian Pacific and Kansas City Southern.
The OEA will now prepare and issue a draft environmental study, which will lay out the potential environmental impacts of the proposed acquisition and include recommendations. The office will solicit public comments on the draft and hold public meetings after the draft is issued, STB officials said in a press release.
Meanwhile, the STB has postponed deciding whether anticipated responsive applications from BNSF Railway Co. or CN are "minor" or "significant" transactions until such applications are filed.
On Jan. 12, BNSF and CN each filed descriptions of anticipated responsive applications in the review of the CP-KCS merger application. In addition to its description of responsive applications, BNSF also filed a petition for waiver and clarification.
The STB's Feb. 18 decision clarifies and waives certain filing requirements for BNSF’s planned responsive applications, board officials said in a press release.
