STB sets schedule for evidence in Amtrak-CN dispute

The Surface Transportation Board (STB) has adopted a procedural schedule for considering Amtrak and CN's joint request that the board establish terms and compensation for the intercity passenger railroad’s use of CN facilities and services.

On Aug. 9, 2019, the board issued interim findings and guidance and initiated board-sponsored mediation to facilitate further negotiations between Amtrak and CN. The mediation period was extended, and on Jan. 22, 2020, mediation between the two ended without a settlement.

On Jan. 25, 2022, Amtrak and CN filed a joint motion to establish a procedural schedule, STB officials said in a press release.

Yesterday, the STB granted the joint request to establish a procedural schedule, but shortened the time requested, considering the extensive record already developed.

Opening submissions are due May 2 and reply submissions are due July 1. Rebuttal submissions are due on Aug. 1.
