STB to weigh arguments next month in NS tariff dispute

On Oct. 25, Surface Transportation Board (STB) members will hear oral arguments in a case involving Norfolk Southern Railway and five rail shippers.
Ag Processing Inc. initially filed a petition with the STB challenging the reasonableness of an NS tariff. Bunge North America Inc., Archer Daniels Midland Co., Louis Dreyfus Corp. and Perdue Agribusiness Inc. later joined the petition.
“At issue is the tariff's imposition of charges and penalties on loaded rail cars that exceed an individual car’s weight limit because of weather conditions encountered after the cars are delivered to NS,” STB members said in an oral argument notice.
At the petitioners’ request, the board previously ordered the parties to mediate their dispute, but mediation was “unsuccessful” and NS later filed a motion asking the STB to dismiss the petition, board members said.
