Canadian Pacific and Kansas City Southern last week filed with the Surface Transportation Board a response to the comments and issues that various parties have shared in filings with the board regarding CP's acquisition of KCS.
The over 4,300-page document filed July 12 addresses the various issues raised by other railroads and other parties as the STB considers whether to approve the CP-KCS merger.
The application for the merger’s regulatory approval "is compellingly in the public interest and should be approved without conditions beyond those embodying commitments" that CP and KCS are making to ensure "that the public interest benefits of the combination" come to pass, the two Class Is stated in the filing.
The merger “is supported by hundreds of shippers, short lines, passenger-rail interests, labor organizations and others,” the filing states. No shipper or shipper association has asked the STB to deny the acquisition; the Federal Railroad Administration has endorsed the CP-KCS safety implementation plan; and Amtrak has supported the merger, the Class Is stated.
