The Surface Transportation Board (STB) should reject as “incomplete” the application for Canadian Pacific to take over Kansas City Southern, Union Pacific Railroad officials said in a filing last week.
The application does not include all the information needed to satisfy market analysis and operational data requirements under STB rules that apply to the CP-KCS merger proposal, the filing stated.
"The application's principal failing is the exclusion of approximately 360,000 carloads, or more than 32% of the potentially divertible traffic, from its diversion analysis," UP officials said. "As a result, the application fails to describe “the impacts of the proposed transaction — both adverse and beneficial — on a significant portion of traffic that applicants themselves identified as potentially affected by the proposed transaction."
