Southeastern Pennsylvania Transportation Authority (SEPTA) recently settled a lawsuit with American Premier Underwriters Inc. (APU) over reimbursement costs for removing contaminants from soil at the 28-acre Paoli rail yard in Chester County, Pa.

Penn Central Railroad successor APU will pay SEPTA $23 million; SEPTA will pay Conrail $9 million of the funds.

In 1986, the U.S. Environmental Protection Agency ordered SEPTA, Conrail and Amtrak to clean up the site, which had become contaminated from a coolant used in rail-car transformers. The railroads complied, but in the early 1990s sued Penn Central, claiming the road was responsible for most of the contamination.
