Canadian Pacific announced yesterday it intends to appoint Ronald Batory as the new trustee of the CP-KCS voting trust associated with the proposed merger.

The appointment is under review by the Surface Transportation Board, which continues to evaluate the merger of CP and Kansas City Southern. Batory would succeed former KCS President and CEO David Starling, who died Feb. 26. Starling had served in the role since the voting trust's formation in December 2021 upon the closing of CP's acquisition of KCS.

If approved, Batory's appointment would be effective immediately, CP officials said in a press release.

Batory has more than 45 years of rail industry experience, including stints as president of the Belt Railway Co. of Chicago and president and chief operating officer of Conrail. He also served as administrator of the Federal Railroad Administration from 2018 to 2021.
