NS, plaintiffs to settle personal injury class action suit pertaining to last year's Graniteville derailment

Norfolk Southern Corp. recently reached an agreement-in-principle with plaintiffs’ attorneys on a proposed class action settlement pertaining to injuries caused by a January 2005 derailment in Graniteville, S.C.

Under the agreement, NS would provide compensation for personal injury claims associated with the derailment that weren’t part of last year’s class action settlement, which covered property damage, evacuation expenses and losses, and minor personal injuries. People who were injured, received medical treatment or were hospitalized because of chlorine released after the accident would receive compensation under the new settlement.

The parties plan to file a motion for preliminary court approval in early November.

“By reaching this proposed agreement, all parties are acting in the interest of the people who suffered varying degrees of injury that were not encompassed in the first class settlement,” NS officials said in a prepared statement.
