CSXT settles long-standing rate dispute with Duke Energy

Duke Energy Corp. has settled its second rate dispute with a Class I in a week. The utility reached a settlement with CSX Transportation to resolve a nearly four-year-old rate case filed with the Surface Transportation Board.

Duke Energy will obtain a separate multi-year rail transportation contract charging rates comparable to tariff rates the company has been paying since 2002. The settlement also provides the utility “beneficial access for rail transportation” from new coal suppliers, according to a prepared statement.

Last week, Duke Energy reached a settlement with Norfolk Southern Corp. to settle a three-year-old rate dispute.

“The contract will help keep our rail rates stable and provide economical options for purchases of coal from new sources,” said Duke Energy Vice President and General Counsel Paul Newton. “Like the recent settlement with Norfolk Southern, these benefits will be passed on to customers annually in our fuel clause adjustment.”
