Companion bills offer protection to striking rail workers

Sister bills recently introduced in Congress might be watched closely by railroads and unions when the House and Senate reconvene from summer recess Sept. 5.
H.R. 2320, introduced in the House June 26 by Rep. John Tierney, D-Mass., and S. 1107, introduced in the Senate June 27 by Sen. Tom Harkin, D-Iowa, would amend the National Labor Relations Act and Railway Labor Act to prevent discrimination against unionized workers who participate in labor disputes.
The amendments would prohibit employers from offering permanent replacement status to individuals who replace striking employees, or giving certain employment preferences to replacement workers over striking employees who returned or made unconditional offers to return to work.
H.R. 2320, which to date has 27 co-sponsors, was referred to the House's Committee on Education and Workforce, Committee on Transportation and Infrastructure, and Subcommittee on Railroads.
S. 1107, which has 15 co-sponsors, was referred to the Senate Committee on Health, Education, Labor and Pensions.
