Surface Transportation Board Sept. 19 announced that Union Pacific Railroad and E.I. du Pont de Nemours and Co. reached a settlement concerning certain car charges — the fourth such settlement reached between several private tank-car owners, and UP and Burlington Northern Santa Fe.


North America Freight Car Association (NAFCA), Railway Progress Institute's Committee on Tank Cars, The Chlorine Institute Inc., and E.I. du Pont de Nemours and Co. last year asked STB to declare that certain BNSF and UP charges for storing cars or diverting them from their original destinations are improper departures from agreed-upon allowances because they apply to services that allegedly already are covered by a tank-car allowance formula.


In an October 2001 decision, the board directed the parties to try and privately settle five separate disputes.


Settlements were reached between Committee on Tank Cars and BNSF in March; The Chlorine Institute and UP in April; and Committee on Tank Cars and UP in May.


The only remaining dispute involves NAFCA and BNSF.
