Judgment call: Canada's Transportation Appeal Tribunal puts rail, marine, aviation on same review/appeal plane

On June 30, the Transportation Appeal Tribunal of Canada Act went into effect, establishing the Transportation Appeal Tribunal of Canada (TATC) — a multimodal tribunal that replaces the Civil Aviation Tribunal as a means to provide the marine and rail communities with the same review and appeal rights on enforcement decisions previously available to Canada's aviation industry.



An independent, quasi-judicial body that reviews administrative and enforcement actions taken under various acts, TATC shifts the reviews and appeals of these actions from the courts, the Minister of Transport and senior government officials to a body of members with a variety of transportation expertise.



"The new multimodal tribunal will deal with appropriate cases more quickly and economically than is currently possible through the criminal court system," said Transport Minister David Collenette in a prepared statement. "We can now deal with less serious regulatory violations by administrative actions which provide for a faster and more accessible hearing process."
