NS asks federal court to approve class action agreement associated with Graniteville train accident

Yesterday, Norfolk Southern Corp. announced it filed a motion in a federal court seeking preliminary approval of a class action agreement that would provide compensation for personal injury claims associated with the January 2005 Graniteville, S.C., train derailment. NS reached the pact with plaintiffs’ counsel in October.

The agreement would cover claims that weren’t part of a class action settled last year to address property damage, evacuation expenses and losses, and minor personal injuries.

If approved by the court, the settlement would stipulate varying levels of compensation for people who were injured and received medical treatment or hospitalized because of the derailment and subsequent chlorine spill, which killed nine and injured dozens.
