On Tuesday, the Surface Transportation Board issued nine decisions during an open voting conference.
The board voted to:
• deny the District of Columbia’s and Sierra Club’s request to reconsider the STB’s decision on the D.C. hazardous materials ban;
• dismiss New England Transrail L.L.C.’s petition seeking approval to construct 2,700 feet of track, acquire 1,300 feet of track and operate all the track in Wilmington and Woburn, Mass.;
• deny United Transportation Union’s and Brotherhood of Locomotive Engineers and Trainmen’s petitions to hold a hearing on the Kaw River Railroad Inc.'s plan to acquire 18.2 track miles of track in Kansas City, Kan. and Mo.;
• deny Terminal Warehouse's petition to reconsider a prior decision on CSX Transportation’s plan to abandon a 0.7-mile line in Summit County, Ohio;
• accept Excel Energy’s technical corrections pertaining to a coal rate case against BNSF Railway Co.;
• deny Concerned Citizens’ request for a hearing to reconsider a decision on Union Pacific Railroad’s abandonment of a 21.6-mile
line in Rio Grande and Mineral Counties, Colo.;
• respond to a U.S. district court request regarding federal preemption of city zoning laws, as applied to railroad right of way, for a Denver & Rio Grande Railway Historical Foundation rail line;
• deny landowners’ request to reconsider the revocation of
earlier decisions that authorized rail banking/interim trail use for portions of a Norfolk Southern Railway line between Kokomo and Rochester, Ind.; and
• dismiss the Washington Department of Transportation’s motion to seek a verified exemption notice to acquire seven lines totaling 188 track miles from the Palouse River and Coulee City Railroad Inc.
